Faridabad housing society loses licence for 109-acre project

A cooperative housing society developing a mega residential project in Sector 49 of Faridabad is in the dock with the Haryana Government cancelling its licence to develop a residential plotted colony for allegedly not adhering to terms and conditions of allotment.

In his order, K. Makrand Pandurang, Director, Town and Country Planning (DTCP) cancelled the licence of the Ex-Sainik Karamchari Cooperative House Building Society vesting the state government with over 109 acres of land.

The society was first granted a licence to develop a residential colony in 1985 for a period of three years. The licencee applied for the renewal of licence in March 1988, September 1989, November 1990, July 1992, December 2000, February 2004 and 2011 but the renewal fee was not deposited as per the Haryana Development and Regulation of Urban Areas Rules, 1976,” the order said.

The licence was earlier cancelled by the DTCP on December 10, 2009, September 27, 2011, and October 11, 2013, but the licencee went in for appeal against the order to appellate authorities —Principal Secretary, Town and Country Planning, which did not provide any relief to it. The society did not get any relief from the Punjab and Haryana High Court too.

According to the order, an amount of Rs 19.83 crore was outstanding against the licence renewal fee as on April 4, 2018, while an amount of Rs 50.62 crore was outstanding by way of external development charges (EDC) as on April 9, 2018.

Meanwhile, the society failed to execute the development works, get the service plan estimates approved and failed to provide basic amenities to the allottees. Besides, the society failed to get the completion certificate and was involved in illegal selling of land,” the order asserted.

What next?

  • MC to take over administration of the colony.
  • Society directed to pay dues, including Rs 19.83 crore licence renewal fee and Rs 50.62 crore as EDC.
  • Authorities may sell unsold property to recover government dues.
  • Show cause notices to all office-bearers since 1988.
